These Terms of Service (“Terms”) apply to your use of molardentalmarketing.com and to any services you purchase from Molar Marketing (“we,” “us” or “our”). By using our website or purchasing our services, you agree to these Terms. If you sign a separate service agreement with us, that agreement controls if anything conflicts with these Terms.

1. Our services

We provide website design, hosting and care plans, Google Business Profile management, website audits, branding and print services for dental practices, RDHAPs and related businesses. The exact scope of your project is described in your plan or service agreement.

2. Plans and payments

Easy Start Plan. You pay a one-time setup fee to start, then a monthly payment for 12 months.

Pay in Full. You pay one time for the same website, plus any perks listed for that option.

Autopay. Monthly plans are billed automatically to the card or account you provide through our payment provider, Stripe.

Paying early. You may pay your remaining Easy Start balance at any time.

Failed payments. If a payment fails, we will notify you. If it is not resolved within 14 days, we may pause your website, edits or other services until your account is current.

Prices are listed on our website and may change for new clients. Your price is locked for your current term.

3. Ownership of your website

You own your website once your 12-month term is complete or your plan is paid in full. Until then, your website stays on our hosting and remains our property.

You always own the content you provide to us, such as your logo, photos and text.

After ownership transfers, you may stay on our month-to-month Care Plan or move your website to another provider. We will provide reasonable help with the transfer.

4. Care Plan and monthly edits

Every plan includes 12 months of hosting, SSL and monthly edits. After month 12, you may continue on our month-to-month Care Plan at the rate listed for your plan.

Monthly edits include text updates, new photos, hours, service changes and small tweaks:

– RDHAP plans: up to 30 minutes per month
– Practice plans: up to 60 minutes per month

Unused time does not roll over. New pages, redesigns and new features are quoted separately.

5. Cancellations and refunds

Cancellation. If you cancel before your 12-month term ends, the remaining balance of your term is due.” Your website stays on our hosting and does not transfer to you until the full term is paid.

Refunds. Setup fees are non-refundable once design work has started.

Google Business Management requires a 3-month minimum. After that, it continues month to month and may be canceled with 30 days’ notice.

6. Your responsibilities

To keep your project on schedule, you agree to:

– Provide content, photos and approvals in a timely manner
– Make sure you have the rights to any content you send us
– Make sure the information on your website is accurate

You are responsible for making sure your website content, including services, pricing, credentials and patient testimonials, follows the advertising rules of your state dental board and any laws that apply to your practice. Do not send us patient health information.

7. Results

We work hard to help you get found and booked, but we cannot guarantee specific search rankings, traffic, leads or revenue. Search engines like Google control their own results and can change them at any time.

8. Third-party services

Our services rely on third-party tools such as hosting providers, Google, Stripe and form and scheduling software. We are not responsible for outages, policy changes or issues caused by those providers.

9. Portfolio

We may display your website or brand work in our portfolio and marketing. If you prefer we do not, let us know in writing.

10. Limitation of liability

To the fullest extent allowed by law, our total liability for any claim related to our services is limited to the amount you paid us in the 3 months before the claim. We are not liable for lost profits, lost data or indirect damages.

11. Website use

You agree not to misuse our website, including attempting to hack, disrupt or copy it. All content on this website, including text, graphics and design, belongs to Molar Marketing unless stated otherwise.

12. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they last changed.

13. Governing law

These Terms are governed by the laws of the State of California.
